Notice sent to the 2nd respondent, no other than the husband of the 1st petitioner, covered by the track record shows delivered on 24.12.2018 to the address within the jurisdiction of Peddapally Head Post Office and even in the transfer petition his address is shown as working as Assistant Manager of State Bank of India, Basantha Nagar Branch, Peddapally.

The petitioners are seeking to transfer M.C.No.21 of 2009 on the file of the Judicial Magistrate of First Class, Parkal, Warangal District, to the Judicial Magistrate of First Class, Peddapally, where D.V.C.No.5 of 2018 is filed by the 1st petitioner and pending against the 2nd respondent. The petitioners are residents of Bhupalapally Village and Mandal of Warangal District and it is mentioned it is convenient to both sides to persue both the matters if pending before the same Court.

By taking considering all these facts, the transfer criminal petition is allowed withdrawing M.C.No.21 of 2009 on the file of the Judicial Magistrate of First Class, Parkal, Warangal District, by transferring the same to Judicial Magistrate of First Class, Peddapally, to try simultaneously and separately without clubbing with D.V.C.No.5 of 2018 said M.C.No.21 of 2009 by allotting fresh

number and only after notice to the respondents to the said M.C. and after their appearance and according to law.
