HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 3 4 1 9 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Chinna Chowk U/ G P.S., Kadapa District, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that on 26.05.2018, one referred complaint received in the Chinna Chowk P.S., Kadapa District, wherein the writ petitioners made a complaint before the II-Additional Judicial Magistrate of First Class, Kadapa, against respondents No.5 to 11. Basing on the above, a case in Cr.No.136/ 2018 registered under Section 323, 418, 420, 423, 427, 468,471, 474, 506 r/ w 34 I.P.C., and Section 156(3) Cr.P.C., of Chinnachowk U/ G P.S., by ASI 1447. The Sub-Inspector of Police, Chinna Chowk P.S.

, examined and recorded the statements of both the writ petitioners. The SubInspector of Police, Chinna Chowk examined and recorded the statements of 4 witnesses. The SubInspector of Police visited the scene of offence and drawn rough sketch. The Inspector of Police, Chinna Chowk U/ G P.S., issued requisition to the Tahasildar, Kadapa Mandal, Kadapa District, to furnish the information that the alleged Voter ID cards and family certificate of Chagaleti Ramaiah are genuine or not for the purpose of investigation. The Tahsildar opined that the voter card/ holders 1) ZUP 1731828 which is on the name of C.Ramaiah, 2) ZUP 1731810 C.Eswaraiah are not found in their server. However, the family members certificate vide OOCC 46967467 is genuine which was issued by the then Tahsildar, Kadapa, consist of C.Ramaiah (A.

C.Eswaraiah-A.3 which proved that the allegations of the complainant has been ruled out.

The investigation in this case is pending for want of examination of some more witnesses.

It is submitted that the investigation done in this case reveals that and as per the testimonies of the statements of witnesses who are the neighbours of the site and alleged scene of offence, nothing happened as stated by the writ petitioners.

It is submitted that the writ petitioners knowing fully well with regard to the civil dispute is pending before the District Court, Kadapa, filed the present Writ Petition with false and baseless allegations."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Chinna Chowk U/ G P.S., Kadapa District, with a further direction to the respondent-Police to complete the investigation, as expeditiously as possible.
