Heard Sri L.Prabhakar Reddy for petitioner, the Assistant Government Pleader for Social Welfare) and Sri M.Rajamalla Reddy for 5th respondent.
The petitioner challenges Proceeding No.C2/ 183/ 2016, dated 02-11-2017.
The impugned proceeding is appealable under Section 7 of the A.P. (Scheduled Castes, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993. The counsel for petitioner submits that the principles of natural justice have been violated and hence, the writ jurisdiction is availed.
Mr.Rajamalla Reddy explained the totality of circumstances and submits that the proceedings are tenable both in law and facts.
By taking note of respective submissions, this Court is of the view that remedy of appeal ought to be pursued before the writ jurisdiction of this Court is invoked by the petitioner. Hence, the writ petition is disposed of by this order. (a) The proceeding impugned is suspended for a period of four weeks from today.
(b) The petitioner is directed to avail the remedy of appeal within ten days from today by enclosing a copy of this order.
(c) The 1st respondent considers entertaining the appeal and also the application filed for stay/ suspension of proceeding dated 02-11-2017 and passes orders within two weeks thereafter.
(d) The 1st respondent considers issuing of notice to 5th respondent as well during and in the course of hearing of either appeal or stay application.
Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
