Heard the learned counsel for the petitioners and the learned Government Pleader for Panchayat Raj and Rural Development. 2.
The grievance of the petitioners in the present writ petition is the inaction on the part of the respondents in holding election to the post of Sarpanch of Phanidaram Gram Panchayat, Tadikonda Mandal, Guntur District, as per the provisions of A.P. Panchayat Raj Act, 1994. According to the petitioners, pursuant to the election held in the month of August 2013, one Sri Karnati Appa Rao got elected as Sarpanch of the Grampanchayat and subsequently he submitted his resignation and the same was accepted on 30.07.2015 under Section 23 of the A.P. Panchayat Raj Act, 1994. It is further submitted by the learned counsel for the petitioners that as per the provisions of sub-Section (4) of Section 14 of the Act it is obligatory on the part of the respondents to hold elections within a period of 120 days from the date of occurrence of vacancy.

When the matter is taken up, it is submitted by Sri V.V. Prabhakar Rao, learned Standing Counsel for the second respondent/State Election Commission that the Commission has already initiated steps to hold election for the said vacancy and two months time may be granted for the same. 4.
The above submission of the learned Standing Counsel is recorded and the writ petition is disposed of, directing the respondents to hold election to the post of Sarpanch of Phanidaram Gram Panchayat, Tadikonda Mandal, Guntur District, within a period of two months from the date of receipt of this order. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
