HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43952 of 2016 ORDER:

This writ petition is filed seeking to quash the FIR No.220 of 2015.

Heard and perused the material available on record. Respondents 4 to 6 filed a private complaint before the learned XXVI Junior Civil Judge-cum-Metropolitan Magistrate, Cyberabad, against the petitioner and six others, which was referred to the 2nd respondent under Section 156(3) IPC and the 2nd respondent registered the said complaint as FIR No.220 of 2015 for the offences under Sections 120-A & B, 464, 469, 420, 471 read with 34 IPC and Section 156(3) Cr.P.C. against the petitioner, who is arrayed as A-4, and six others. It is alleged in the above said complaint that A-1 to A-4 created false documents and managed and colluded with Revenue staff and Sub-Registrar for monitory benefits by executing the documents vide Document Nos.

1238 of 1993 and 1520 of 1996 with the help of A-2, A-3, A-5 to A-7 and that the accused forged the signature and created false documents and colluded with the revenue staff and cheated respondents 4 to 6, in respect of the property to an extent of Ac. 1.30 guntas, in Survey No.475, situated in Lemoor Village. The main grievance of the petitioner is that respondents 4 to 6 are harassing the petitioner in multiple ways and putting pressure on the 2nd respondent to arrest the petitioner, in order to usurp the subject land, which the petitioner claims to be the purchaser of the subject land.

Considering the grievance of the petitioner, 2nd respondent is directed to complete the investigation in FIR No.220 of 2015 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to execute personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum to the satisfaction of the 2nd respondent as surety for his future appearance for the purpose of investigation. With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
