The petitioner filed FCOP.No.799 of 2015 on the file of the Additional Judge, Family Court, Visakhapatnam, to declare that the decree for dissolution of marriage obtained by him from a
Sydney Court binds the respondent. When the FCOP was sought to be proceeded with, a request was made on behalf of the petitioner before the Court below that the case may be adjourned by three months. The lower Court did not accede to his request and adjourned the case to 18-07-2016 on payment of costs.
At the hearing, the learned Counsel for the petitioner submitted that the case was further adjourned to 04-08-2016 and 08-08-2016.
Ordinarily, a litigant cannot insist on the Court to fix a schedule of his convenience. However, considering the fact that the petitioner is a resident of Sydney at Australia, some reasonable latitude may be permitted in his favour, if necessary, by holding trial through video conferencing. The petitioner is permitted four weeks' time to make arrangements either for his personal appearance and participating in trial or for requesting the lower Court to conduct the trial through video conferencing.
The Civil Revision Petition is, accordingly, disposed of.
As a sequel to disposal of the Civil Revision Petition, CRPMP.No.4547 of 2016, filed by the petitioner for interim relief, is disposed of as infructuous.
