HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43402 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 1st respondent in not granting exemption under Section 154 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short, "the Act"), to the petitioner Choultry, both in respect of Sections 15 and 29 of the Act, in spite of the representation dated 9.3.2018, submitted by the petitioner, as illegal and arbitrary.

The learned counsel for the petitioners submits that though the petitioner submitted the representation on 9.3.2018 to the respondent authorities requesting to grant the petitioner's Choultry a similar exemption granted to the Choultries and Annadana Samajams, maintained by the Arya Vysya Community, in respect of Sections 15 and 29 of the Act, no action has been taken so far. Learned Government Pleader for the Endowments, would submit that if the representation of petitioner is still pending consideration, the 1st respondent authorities may be directed to pass appropriate orders, in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 1st respondent, to deal with the representation dated 09.03.2018, submitted by the petitioner seeking to grant his Choultry, a similar exemption as granted to the Choultries and Annadana Samajams, maintained by the Arya Vysya Community, in terms of Section 29 of the Act, and pass appropriate orders, in accordance with law as early as possible preferably within a period of three to six weeks from the date of receipt of copy of this order, after giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
