HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No.1622 OF 2018 JUDGMENT (ORAL): (Per The Hon'ble The Chief Justice Sri Thottathil B. Radhakrishnan) We have heard the learned counsel for the appellants, learned Government Pleader for Mines and Geology appearing for respondent No.1, learned Government Pleader for Revenue appearing for respondent No. 2 and learned Government Pleader for Home appearing for respondent No.3.

2. We are of the view that the impugned interlocutory order of the learned single Judge is eligible to stand subject to the modification that instead of remitting Rs.1,00,000/- (Rupees one lakh only), it would suffice that Bank Guarantee or Security for Rs.1,00,000/- (Rupees one lakh only) to the satisfaction of respondent No.2 - The Tahsildar, Amadalavalasa Mandal, Srikakulam District, is provided. All other conditions stated in the impugned interlocutory order will continue to bind the petitioners through out. The impugned order is modified accordingly.

3. The writ appeal is allowed in part as ordered above. There shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in the Writ Appeal stand closed.
