Yalavarthy Cold Storage v. Union Bank Of India,
THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.18415 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition is to the notices under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. It is a settled legal position that no writ petition would lie against such notices (DEVI ISPAT LTD. v. SBI[1]).
The writ petition is accordingly dismissed on this short ground without going into the merits of the matter. This order shall however not preclude the petitioners from pursuing their remedies as regards the impugned demand notices at the appropriate stage in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
