THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.318 of 2016 ORDER:

1. This Criminal Revision Case is filed by the petitioner aggrieved over the order dated 6.1.2016 passed in Crl.M.P.No.1490 of 2015 in M.C.No.3 of 2015 by the Judicial First Class Magistrate, Railway Kodur.

2. The 1st respondent, who is the wife of the petitioner, filed the above M.C. against the petitioner. During the pendency of the same, the petitioner filed the above Crl.M.P. seeking to dispense with his personal appearance before the trial Court. The trial Court dismissed the said Crl.M.P. Aggrieved by the same, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. This Court is of the view that in a case of this nature, the presence of the petitioner or the 1st respondent is not always required and further, the petitioner can be represented through his Counsel. Therefore, this Court is inclined to pass the following order: "The presence of the petitioner before the trial Court concerned is dispensed with except on the dates of his chief and crossexaminations. The petitioner is directed to be represented through his Counsel on all hearing dates."

5. Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
