THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.1212 OF 2018 JUDGMENT:

This appeal is filed under Order XLIII Rule 1 C.P.C. challenging the order dated 07.08.2018 passed in I.A.No.100 of 2018 in A.S.No.85 of 2018 on the file of X Additional District Court, Tirupati.

At the time of arguments, the only relief sought by the learned counsel for the appellants is to direct the first appellate Court to dispose of A.S.No.85 of 2018 as expeditiously as possible. 3.

In view of the submission made by the learned counsel for the appellants, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the learned X Additional District Judge, Tirupati, is hereby directed to dispose of A.S.No.85 of 2018, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order without being influenced by the observations made in I.A.No.100 of 2018.

With the above direction, the Civil Miscellaneous Appeal is disposed of. There shall be no order as to costs. 6.

Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
