THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1531 of 2016 ORDER:

The grievance of the petitioner is that the Tahsildar, Palwancha Mandal, Khammam District, the 4th respondent, is not issuing him a Community and Date of Birth Certificate certifying that he belongs to STKoya Community, though he submitted application dated 15.12.2015 with all necessary documents.

As the petitioner's application is still pending consideration before the 4th respondent, this Court is not inclined to entertain this writ petition and adjudicate the same on merits. It is for the 4th respondent to apply his mind and take appropriation action in the matter in accordance with law.

The writ petition is therefore disposed of directing the 4th respondent to consider the petitioner's representation dated 15.12.2015 and in the event there is any shortfall of required documentation, the 4th respondent shall call upon the petitioner to make good the same within a time frame and thereafter take appropriate action in the matter in accordance with law. In the event the 4th respondent rejects the request of the petitioner for issuance of a caste-cum-birth certificate, he shall record the reasons therefor and communicate the same to the petitioner.

This entire exercise shall be completed expeditiously and in any event, not later than four (4) weeks from the date of receipt of a copy of this order.
