This Criminal Revision Case is arising out of the order, dated 22.10.2018 passed in C.C.No.170 of 2017 by the Additional Junior Civil Judge, Palakol.

The revision petitioner is the defacto complainant. Basing on the complaint of the defacto-complainant, C.C.No.170 of 2017 was registered. During pendency of proceedings, the complainant was absent and the trial Court has passed the order, dated 22.10.2018 discharging A1 to A6. Aggrieved by the impugned order, the petitioner has approached this Court.

Heard Mr.S.R.Sanku, learned counsel for petitioner and the learned Public Prosecutor for the State.

In view of proviso under Section 397(1) Cr.P.C., the petitioner has got remedy to approach the District Court or this Court for redressal of his grievance.

Hence, the petitioner is given liberty to file an application before the Sessions Court within two weeks from the date of receipt of a copy of this order. On filing such application, the Sessions Court shall consider and pass appropriate orders in accordance with law.
