THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36139 of 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the second respondent and his personnel in pressurizing and forcing the petitioners and their family members to execute register sale deeds in favour of the third respondent without any legal cause, as illegal and arbitrary and in violation of Articles 21 and 300(A) of the Constitution of India and consequently, to direct the respondent police not to interfere with the personal affairs of the petitioners.
Heard and perused the material.
Learned counsel for the petitioners submits that the second respondent and his personnel are interfering in the civil dispute between the petitioner and the third respondent, and that they are forcing the petitioners to register sale deeds in favour of the third respondent and as such, he seeks a direction to the second respondent not to interfere with the personal affairs of the petitioners. Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the second respondent is not interfering with the affairs of the petitioners and they are not forcing the petitioners to execute any sale deeds in favour of the third respondent.
Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the second respondent not to interfere in the civil disputes between the petitioners and the third respondent. The second respondent is further directed to follow the due process of law laid down in Code of Criminal Procedure.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 26.10.2016 pln
