O R D E R

Pursuant to the order passed by this Court on 05.01.2016, the petitioner's answer script is placed before this Court. Perusal thereof reflects that the answer script relates to No.066 and the counterfoil attached thereto reflects that the main answer book bearing Serial No.066 was given to Dhuppe Shuddhodhan, the petitioner herein.

The answer script reveals that the petitioner was awarded 3 marks for the first question, 3 marks for the second question, 0 marks for the third question, 3 marks for the fourth question, 0 marks for the fifth question, 0 marks for the sixth question, 2 marks for the seventh question, 1 mark for the eighth question, 0 marks for the nineth question, 2 marks for the tenth question, 2 marks for the eleventh question, 0 marks each for the twelfth, thirteenth, fourteenth, fifteenth, sixteenth, seventeenth, eighteenth and twentieth questions. He was awarded 1 mark each for nineteenth and twenty first questions. 0 marks for twenty second, twenty third, twenty fourth, twenty fifty and twenty sixth questions bringing the total marks to 18.

Though the matter was passed over during the morning session to enable production of the answer script, it was not brought to the notice of this Court that the petitioner was not present. When the answer script was produced and placed before the Court in the afternoon session, the petitioner is again not present. There is therefore no possibility of enabling the petitioner to peruse the answer script. As the matter was specifically adjourned to enable production of the answer script for this purpose and as the petitioner is not present, this Court is not inclined to grant further time on this count.

Learned Assistant Government Pleader states that the rules do not permit review of the marks awarded and recounting has already been done at the request of the petitioner.

The grievance of the petitioner to the effect that his answer script

was not properly evaluated therefore does not hold water and the writ petition is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 19th JANUARY, 2016 Svv
