HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 21250 of 2016 ORDER:

The first petitioner claims to be the Regional Secretary of the A.P.

State Electricity Employees Union No.

(Recognized). He is working as Senior Assistant in the Office of the Superintending Engineer, Operation circle, APEPDL, Eluru, first respondent herein. He states that the Union is having 600 members consisting of employees of various cadres. The Office Bearers of the second petitioner-Union were extended with protection from transferring to other places from the place where they are working. When an order of transfer was passed

on 25.06.2016 transferring the first petitioner from the office of the first respondent to the Electricity Revenue Office, Eluru Town, the present Writ Petition was filed by impleading the Union as second petitioner.

A perusal of the impugned order of transfer would show that the first petitioner was not disturbed in carrying out the union activities from the place where he is posted and he cannot claim protection in transferring him from the place where is working to another office of the same place. The protection of transfer cannot be extended to the post, but it should be confined to place and the said policy is not violated in the instant case. Further this Court noticed that though the Union was impleaded as second petitioner to the Writ Petition, no resolution authorizing the first petitioner to file the present Writ petition on behalf of the second petitioner-Union is filed. In the circumstances, this Court finds no ground, much less a substantial and valid ground to interfere with the impugned order of transfer dated 25.06.2016 transferring the petitioner from the office of the first respondent to the office of the second respondent.

The Writ Petition is accordingly dismissed at the admission stage. However, this order will not prevent the first petitioner from representing his grievance, if any, to the concerned authorities.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
