HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI FAMILY COURT APPEAL No.78 OF 2016 JUDGMENT: (Oral, Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present Appeal, the appellant has challenged the order, dated 11.02.2016, passed in O.P. No.650 of 2012 by the Judge, Family Court-cum-IV Additional District and Sessions Judge, Vijayawada (for short, 'the Court below); whereby the Court below partly allowed the Petition by directing the appellant to pay monthly allowance of Rs.5,000/- each to his two daughters i.e., respondents 2 and 3 from the date of petition by creating charge over the petition schedule property while declining to grant monthly maintenance of Rs.15,000/- to his wife i.e., 1st respondent. Thereafter, with the permission of this Court, the said property has been sold by the appellant for an amount of Rs.21,00,000/- and, accordingly, the appellant deposited an amount of Rs.10,50,000/- each in the accounts of respondents 2 and 3 towards the full and final settlement of their claims.

The said permission was given by this Court, on 21.06.2018, on the ground that the appellant has no other source of income to pay monthly allowance of Rs.5,000/- each to the respondents 2 and 3. Thus, the appellant has satisfied the order, dated 11.02.2016, passed in O.P. No.650 of 2012.

Recording the same, the Family Court Appeal is disposed of. No order as to costs.
