HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40305 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents 3 & 4 in interfering with the civil disputes between the petitioners and the 5th respondent in respect of land of an extent of Ac.1.90 cents in Sy.No.251 of Machavaram Village and Mandal, Narasaraopet, Guntur District, as illegal and arbitrary. Heard and perused the material available on record. The grievance of the petitioners is that 1st petitioner got the above property, which is his ancestral property, through the relinquishment deed from his step-brothers. Subsequently, due to hike in price, the step-brother of the petitioner i.e. 5th respondent, is instigating the respondents 3 & 4 to take action against the petitioners, and the respondents 3 and 4 are calling the petitioners to the police station and insisting them to settle the issue with the 5th respondent. Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.

Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

" The respondents 3 & 4 are directed not to interfere with the affairs of the 1st petitioner and the 5th respondent, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the

respondents 3 & 4 to register a case, if any complaint is lodged against the petitioners for cognizable offence." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J November 22, 2016 KTL
