HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 3 5 6 7 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Chintalapudi Police Station, West Godavari District, dated 06.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that on a complaint from the writ petitioner a case in Cr.No.157/ 2018 was registered by the Sub-Inspector of Police, Chintalapudi P.S., against the respondents 6 to 8 and issued F.I.R. The Sub-Inspector of Police examined the writ petitioner and recorded her statement. Thereafter, the Investigating Officer examined witnesses and recorded their statements. The Investigating Officer visited the scene of offence and drawn rough sketch.

The Investigating Officer enquired with the respondents 6 to 8 about the incident and the respondents 6 to 8 denied the allegations made by the writ petitioner. The Investigating Officer also made confidential enquiries about the alleged offence in this case and the civil disputes arose between the writ petitioner and the respondents 6 to 8 after the death of the husband of the writ petitioner, therefore the writ petitioner filed the present complaint against the respondents 6 to 8.

It is submitted that after completion of enquiry and investigation, the case was referred as false and submitted a report to the Sub-Divisional Police Officer, Jangareddigudem, to accord permission to refer the case as FALSE. The Sub-Divisional Police

Officer, Jangareddigudem, issued proceedings vide C.No.295/ SDPO-J/ Refer/ 2018, dated 30.06.2018.

Thereafter, the Investigating Officer, Chintalapudi P.S., will issued notice to the writ petitioner. After service of notice to the writ petitioner, the Investigating Officer will be filed under Section 173(8) Cr.P.C., as expeditiously as possible." Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Station House Officer, Chintalapudi Police Station, West Godavari District, dated 06.12.2018, with a liberty to the petitioner herein to avail the other remedies open, in accordance with law, after filing the final report..
