HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G. SHYAM PRASAD Writ Petition No.39100 of 2016 ORDER: (per Hon'ble Sri Just ice V. Ramasubramanian) Upon receipt of a demand notice under Section 13(2) of the SARFAESI Act, 2002 (for short 'the Act'), the petitioner has made a representation dated 27.08.2016 to the 2nd respondent and has come up with the present writ petition, seeking writ of mandamus to direct the bank authorities to consider the representation and pass orders. Heard the learned counsel for the petitioner. Normally, only after an order is passed under Section 13(3A) of the Act, the bank will take measures under Section 13(4) of the Act. Therefore, in his own interest, the petitioner should keep quiet. Since the petitioner himself wants the final script of the story to be written, we have no objection to allow the writ petition directing the bank to dispose of the representation.
The writ petition is accordingly allowed, directing the 2nd respondent-Bank to dispose of the representation dated 27.08.2016 of the petitioner, within four weeks from the date of receipt of a copy of this order.
