HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 3 5 8 6 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, CCS Naspur, Ramagundam Commissionerate, dated 02.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The petitioner herein has sent a petition, dated 17.11.2018, to the Commissioner of Police, Ramagundam Commissionerate, stating that he is working as General Mazdoor in underground coal mines of Singareni Collieries since 31 years and in order to shift the Coal from one mine to another, he has entered into transport business by availing loans from 1) Ramesh, 2) Blaster Ravi, 3) Yerra Shekar, 4) Tirupathi, to the tune of Rs.

10 lakhs and thereafter he suffered huge losses in the business and he repaid the entire amount to them along with higher rate of interest upto 3% per month and that taking advantage of the papers i.e., pronote and cheques issued by him, they are trying to exploit him and from 20.10.2018 daily they are coming to his home torturing, threatening to kill him and his family members and they are obstructing him to attend his duties and hence requested to take necessary action against the above named persons, as per law.

Upon receipt of the said complaint on 22.11.2018, the Commissioner of Police, Ramagundam Commissionerate, endorsed it and forwardedth Station House Officer, CCC Naspur Police Station, for immediate action, as per law. On receipt of the said complaint through proper channel, a preliminary enquiry was conducted on the said complaint.

It is submitted that in the preliminary enquiry, it is revealed that no incident whatsoever was happened at the house of the petitioner herein and this respondent Police requested the petitioner to approach this respondent Police along with evidence if any but the petitioner for the reasons best know to him did not turn up to the respondent Police and hence no action was taken on the complaint.

To that effect, a letter dated 30.11.2018 was addressed to the petitioner and communicated the same to him.

It is further respectfully submitted that it appears the dispute of the petitioner herein as well as the unofficial respondents herein is purely civil in nature relating to money transaction. Hence, no action was taken on the complaint.

A detailed enquiry was conducted on the complaint of the petitioner herein and submitted the enquiry report to the Commissioner of Police, Ramagundam Commissionerate, on 29.11.2018. A copy of the enquiry report is annexed to this written instruction for the kind perusal of this Hon'ble Court. It is pertinent to submit that since the dispute of the petitioner as well as the unofficial respondents herein is purely money transaction in respect of issuance of pronote and cheques etc., and hence no action was taken.

In view of the above facts and circumstances, I pray this Hon'ble Court may be pleased to pass appropriate orders, as it may deem fit and proper in the interests of justice."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, CCS Naspur, Ramagundam Commissionerate, dated 02.12.2018, with a liberty to the petitioner herein to avail the other remedies open, in accordance with law.
