Heard.
The petitioner sought conversion of lease in respect of the land admeasuring 84.22 sq. yards in Plot No.71 situated at New Bhoiguda, Secunderabad, granted to him under Lease Deed bearing No.2000, dated 16-10-1954. The petitioner states that as per the policy of the State, he applied for conversion of the leasehold rights into freehold rights under his application to the 3rd respondent on 31-12-2003. The 3rd respondent, thereafter, asked information from the 4th respondent as to whether the premises of the petitioner is being affected by the Metro Rail alignment or Service Road Development Plan (for short 'SRDP'). The petitioner states that an appropriate report was already sent by the 4th respondent to the 3rd respondent on 28-09-2015 stating that petitioner's premises bearing No.6-3-276 is not being getting affected by Metro alignment or SRDP but as per Rules in force, the width of the existing road should be 30 feet. The petitioner states that thereafter the 3rd respondent has not sent any report and the matter is pending with the 2nd respondent.
Learned Standing Counsel for GHMC submits that the 4th respondent has already sent appropriate report to the 3rd respondent stating that the premises of the petitioner is not being affected by Metro alignment or SRDP.
Learned Government Pleader for Revenue, on instructions, submits that the petitioner's application as of now is pending and the extensive correspondence is already made with the GHMC and appropriate decision will be taken.
In view of that, the 3rd respondent is directed to send an
appropriate report to the 2nd respondent with reference to the request of the petitioner within four weeks from the date of receipt of a copy of this order and thereafter the 2nd respondent shall consider the same and pass appropriate orders expeditiously.
Accordingly, the writ petition is disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
