THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No.6312 of 2017 ORDER:
1) Aggrieved by the order dated 03.11.2017, passed in I.A.No.944 of 2017 in O.S.No.276 of 2012 on the file of the Principal Junior Civil Judge, Tuni, wherein an application filed under Section 151 of C.P.C. to re-open the suit for adducing evidence on behalf of the defendants, was dismissed, the present Civil Revision Petition came to be filed under Article 227 of the Constitution of India.
2) At the time when the matter is taken up for hearing, Sri T.N.M.Ranga Rao, who filed vakalath on behalf of the respondent/ plaintiff would submit that the respondent/ plaintiff has no objection to re-open the suit if any particular date is fixed for production of the witness. Learned counsel for the petitioners also agreed for the same.
3) Having regard to the submissions made by both the counsel, the Civil Revision Petition is disposed of directing the petitioners to produce their witness on the next date of adjournment and the counsel for the plaintiff shall cross-examine the witness on the said date and thereafter the trial Court shall proceed in accordance with law and dispose of the case at the earliest. It is
made clear that the trial Court shall not entertain any application filed by the petitioners seeking further adjournment. 4) There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
