THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9848 OF 2016 ORDER:
This Criminal Petition is filed by the petitioners/A-2 and A-3 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.62 of 2016 on the file of Kota Police Station, S.P.S.R. Nellore District, registered for the offences punishable under Sections 493 and 417 I.P.C. and Section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2. Heard and perused the material available on record.
3. Case of the prosecution is that A-1 made the de facto complainant to believe him with false promises that he would marry her and on her force, he tied tali in her neck and since then, he was cohabiting her in the form of her husband and when she forced him to get their marriage registered, he colluded with the petitioners herein, who are his parents, and rejected to do so by saying that his community people would eliminate them from the village.
4. Learned Additional Public Prosecutor opposed the bail application by submitting that there is a bar for grant of bail to the petitioners under the provisions of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act.
5. In view of the submission of the learned Additional Public Prosecutor, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioners.
