HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 8544 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 1st respondent in not considering the case of the petitioner for appointment to the post of Principal for Special Educational Centre at Secunderabad National Institute for Mentally Handicapped. A consequential direction is also sought to appoint the petitioner to the post of Principal for Special Educational Centre. Heard Sri Ch. Ramesh Babu, learned counsel for the petitioner, and Ms. E. Oormila, learned counsel for the 1st respondent. When the matter is taken up for hearing, it is noticed that the name of the petitioner was kept in waiting list and empanelled for appointment to the post of Principal.

Mere keeping the name of the petitioner in waiting list or empanelment of his name for appointment to the post of Principal, would not confer any right on the petitioner. Therefore, no mandamus can be issued in his favour. It is further noticed that this Hon'ble Court vide orders dated 26.12.2002 in WPMP No.10618 of 2002 granted interim direction as prayed for. If the case of the petitioner is considered, he shall not be disturbed, but his case is not considered, the same may be intimated to him.

With the above observations, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 21st August, 2018 cbs
