THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.43699 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.

The alleged inaction, on the part of respondent Nos.2 and 3, in opening suspect sheet against the petitioner herein on 14.04.2013, is under challenge in the present Writ Petition. According to the learned counsel for the petitioner so far there is no conviction against the petitioner herein in any one of the cases registered against him, as such, the provisions of Police Standing Orders, 601 do not attract the case of the petitioner herein and the suspect sheet opened against the petitioner herein cannot be sustained in the eye of law. On the other hand, it is submitted by the learned Government Pleader that, in view of the involvement of the petitioner in certain crimes and in order to have a watch on his movements, it has become incumbent on the part of the respondent-police authorities to open the suspect sheet against the petitioner herein.

Having heard the learned counsel on either side, this Court deems it appropriate to dispose of the Writ Petition, leaving it open for the petitioner herein to make a representation to the second respondent, within a period of ten days from the date of receipt of a copy of this order, and, if any

such representation is made, within the time stipulated supra, respondents are directed to take appropriate action/pass appropriate orders, strictly in accordance with law and also in accordance with the provisions of the Police Standing Orders, 601, within a period of four weeks thereafter. Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
