This writ petition is filed aggrieved by action of the 4th respondent in mutating the names of respondents 5 and 6 only in respect of the land admeasuring Ac.0-37 guntas out of Sy.No.40, situated at Nallagandla village, Serilingampally mandal, Ranga Reddy District as being illegal and arbitrary and for issuance of appropriate consequential directions. Heard the learned counsel for the petitioner and learned Asst. Government Pleader for Revenue. It is emerging from the facts of the case that the petitioner being sister of respondents 5 and 6, when they allegedly denied her share in their father's property, she seems to have filed suit for partition being OS No.1319 of 2016 on the file of XV Addl. District Judge, Ranga Reddy district at Kukatpally and the same is pending trial. This writ petition is filed seeking a direction to the official respondents not to mutate the names of respondents 5 and 6 in respect of the property which is subject matter of suit OS No.1319 of 2016.
Inasmuch as the petitioner has already filed suit and the same is pending, appropriate orders can as well be obtained from the trial Court and the petitioner cannot be allowed to maintain parallel proceedings and seek relief on the same subject matter from this Court. In the circumstances, it is open for the petitioner to make an application before the trial Court
and obtain orders. In view of the same, this writ petition cannot be entertained and it is accordingly disposed of. There shall be no order as to costs.
