THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.43667 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.

The very action of the respondents, in opening and continuing rowdy sheet against the petitioner herein, is under challenge in the present Writ Petition.

According to the learned counsel for the petitioner, in none of the cases, registered against the petitioner herein, there is conviction against him and the impugned action is violative of Articles 14 and 21 of the Constitution of India besides being opposed to the very spirit and object of the provisions of the Police Standing Orders, 601. It is submitted by the learned counsel that, in fact, petitioner herein submitted a representation on 30.08.2018 to the third respondent but no action has been taken so far.

On the other hand, it is submitted by the learned Government Pleader that, in view of the involvement of the petitioner in various crimes, and in order to have a watch on his movements, it has become incumbent on the part of the respondent-police authorities to continue rowdy sheet against the petitioner herein.

Having regard to the above facts and circumstances, Writ Petition is disposed of, permitting the petitioner herein to make

an appropriate application, within a period of ten days from today, before respondent Nos.2 and 3, and if the same is submitted, within the time stipulated above, necessary action be taken by respondent Nos.2 and 3 and appropriate orders be passed, strictly in accordance with law, within a period of four weeks thereafter, in terms of the Police Standing Orders, 601. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
