HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20031 OF 2016 ORDER:
The case of the petitioner is that he is the lawful owner and possessor of residential plot to an extent of 1064 square yards in R.S.No.498/6 of Mustabad Grampanchayat, Vedurupavuluru Revenue Village, Gannavaram Mandal, Krishna District and there existing a 30 feet road passing through the land of the petitioner which was maintained by the Panchayat Raj Department from Payakapuram to Mustabad. While so, the respondents without issuing any notice and without acquiring the land by following due process of law, entered the subject land and started demarcation through the subject land on the ground of laying bye-pass road. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
Learned Assistant Government Pleader for Roads and Buildings-5th respondent submits that before undertaking the work of road widening they will issue notice to the petitioner and they would follow due procedure for acquiring the land of the petitioner .
In view of the above facts and circumstances, the respondents shall not dispossess the petitioner from the subject land without following due process of law. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 28.06.2016 tk
