THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10473 of 2017 ORDER:

Heard learned counsel for the petitioners/A.1 and A.2 and learned Additional Public Prosecutor for the respondent State, and perused the record.

This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioners/A.1 and A.2 in Crime No.19 of 2017 of V.Madugula Police Station, Visakhapatnam District, for the offence punishable under Section 20(b)(ii)(c) read with 8(c) of NDPS Act.

The allegation against the petitioners/A.1 and A.2 is that they were carrying ganja of 50 kgs. On credible information on 27.02.2017, the same was seized from their possession, as per the procedure established, the quantity seized is a commercial quantity. Though charge sheet is filed, it is not a fit case to grant bail, in view of commercial quantity being seized and gravity of offence. Under these circumstances, the Criminal Petition is dismissed. The trial Court concerned is directed to expedite and complete the trial of the case, preferably, within six months from the date of its committal.
