THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos. 42379 of 2015 and 492 of 2016 COMMON ORDER:
W.P.No.42379 of 2015 is filed by three villagers of Kotikesavaram, Korukonda Mandal, East Godavari District, questioning the proposed grant of lease in favour of one K.Srinivasa Rao, the sixth respondent therein, over an extent of Ac.16-00 cents in R.S.No.198/1 of Kotikesavaram Village, Korukonda Mandal, East Godavari District. According to them they have submitted objections under their letter dated 12.10.2015 to the mining authorities concerned but ignoring the same the mining authorities were proposing to grant a lease.

W.P.No.492 of 2016 was filed by K.Srinivasa Rao, the sixth respondent in W.P.No.42379 of 2015, assailing the action of the mining authorities in not processing his application for grant of mining lease.
3. As the mining authorities concerned are yet to apply their mind and take appropriate action upon the mining lease application of K.Srinivasa Rao, this Court sees no purpose served in entertaining these writ petitions and adjudicating them on merits.
4. The writ petitions are therefore disposed of with the following directions:
1. The mining authorities shall consider the application dated 06.05.2015 submitted by K.Srinivasa Rao, the petitioner in W.P.No.492 of 2016, for grant of quarry lease in accordance with law and take appropriate action in the matter.

In the event the request for grant of a
quarry lease is rejected, the reasons therefor shall be recorded and duly communicated to the applicant.
3. In the process of such consideration, the mining authorities shall take into account the objections raised by the petitioners in W.P.No.42379 of 2015 in their representation dated 12.10.2015.

The entire exercise shall be completed expeditiously and in any event, not later than two months from the date of receipt of a copy of this order.
Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
