THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17774 OF 2016 O R D E R:
This writ petition is filed seeking a mandamus to declare the action of Respondents 2 to 4 in not releasing the petitioner's vehicle bearing Registration No. TS 16UA 5588, as illegal and arbitrary. The petitioner is said to be the owner of the above-mentioned vehicle. While transporting sand, on 29.05.2016, the said vehicle was seized near Jannapally-Nadpoor Road. According to the petitioner, as the alleged violation is of first time, he is entitled to get the seized vehicle released by paying the prescribed penalty in terms of G.O.Ms.No.15, Industries and Commerce (Mines-I) Department, dated 19.02.2015 and that in spite of the representation, dated 02.06.2016, made to the 2nd respondent for release of the vehicle, no order has been passed thereon. Inasmuch as the 2nd respondent is authorised to release the seized vehicle in terms of G.O.
Ms.No.15, dated 19.02.2015, the petitioner is permitted to submit an Application to him for release of the seized vehicle. Within three days of receipt of such an Application, the 2nd respondent shall consider the same and pass appropriate orders thereon and communicate the same to the petitioner.
Subject to the above direction, the Writ Petition is disposed of. No costs.
Consequently, the miscellaneous Applications, if any shall also stand disposed of.
