HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Petition Nos.39281 and 39331 of 2016 Common Order: (per V.Ramasubramanian, J.) The petitioners who were working as Ticketing Inspectors in the Squad, of the South Central Railways, went before the Tribunal challenging the orders by which they were posted to far-off divisions. The Tribunal dismissed the original applications forcing the petitioners to come up with the present writ petitions.

2. Heard Mr. Raja Reddy Koneti, learned counsel for the petitioners. Ms. T.Bala Jaya Sree, learned Standing Counsel takes notice for the respondents 1 to 4.

3. The Tribunal has pointed out that the petitioners were actually placed under suspension for certain alleged omissions and commissions. Upon the revocation of the suspension they were posted to far-off divisions. Challenging the transfer orders, the petitioners filed O.A.Nos.176 and 177 of 2016 which were disposed of by the Tribunal directing the South Central Railways to consider the representations. The representations were considered and they were rejected by an order dated 15-02-2016. The rejection was on the ground that the allegations against both of them were very serious in nature and that therefore the orders posting them to far-off divisions could not be interfered with.

4. A careful perusal of the order dated 24-5-2016, by which the representations of the petitioners were rejected would show that the allegations against them were serious in nature. After all upon revocation of suspension, pending enquiry, a person can be posted to any place. The Railway Board's Circular which requires such persons to be accommodated in the adjoining division is only directive and not mandatory. Therefore, we find no merits in the writ petitions, hence, the writ petitions are dismissed.

The miscellaneous petitions, if any, pending in these writ petitions shall stand closed. No costs.
