THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.28656 OF 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for respondents 1 to 4. This Writ Petition is filed to declare the action of the respondents in issuing notice dated 02.08.2016 by inviting objections by not considering the report of the 4th respondent dated 17.10.2015 by cancelling the Dependent Certificate obtained by respondents 5 and 6, as illegal and arbitrary. Learned counsel for the petitioner submits that though the petitioner challenges notice dated 02.08.2016, he is satisfied that enquiry is conducted and action is taken in pursuance of the same.
Learned Government Pleader for Revenue has placed on record the letter dated 27.08.2016 addressed to him by the 3rd respondent, wherein it is stated that enquiry is pending before the 3rd respondent and notices were issued to the petitioner and the 5th respondent for adducing evidence with regard to cancellation of Family Member Certificate issued in favour of the 5th respondent.
Having regard to the facts and circumstances of the case, the 3rd respondent is directed to take appropriate action in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and respondents 5 and 6.
With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
