Apoorva Institute Of Management And Sciences v. Jawaharlal Nehru Technological University Hyderabad,
HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SMT JUSTICE ANIS W.P.No.27847 of 2016 ORDER: (per V. Ramasubramanian, J.) The petitioner institution, who was denied affiliation for admission of students to M.B.A. course for the current Academic year has come up with the above writ petition seeking various reliefs. 2.
Heard Sri S. Sriram, learned counsel for the petitioner and Sri A. Abhishek Reddy, learned standing counsel for the 1st respondent University.
3.
By an order dated 01-07-2016, the University rejected the request of the petitioner for affiliation to M.B.A. course on the ground that there were no Doctorate Degree holders available in the college. The petitioner filed a writ petition in W.P.No.22281 of 2016. In the said writ petition, a learned Judge passed an interim order on 13-07-2016 directing the University to grant time to the petitioner either to explain the deficiencies or to rectify the same within a time frame. Pursuant to the said order, the petitioner has approached the University.
4.
The University passed an order dated 02-08-2016 rejecting the request once again on the ground that the College ought to have employed at least 32 Doctorate Degree holders (16 Professors and 16 Associate Professors) for a student strength of 960 and that though the University granted some relaxation, the college could not
VRSJ & ANIS J W.P.No.27847 of 2016 fulfil even the relaxed criteria. Aggrieved by the said order, the petitioner came up with the present writ petition. 5.
On 22-08-2016, we passed an interim order in the writ petition directing the University to see whether the appointment of one Dr. Duggani Yuvaraju, could be considered as a valid appointment. The University appears to have examined the certificates of Dr. Duggani Yuvaraju and found him to be not fully qualified. 6.
On 08-09-2016 when the writ petition came up once again before us, the certificates of Dr. Duggani Yuvaraju were produced before us. They do not appear to be equivalent to the qualifications prescribed. But it was pointed out that the appointment of one Dr. Franklin John was also not considered. The certificates of Dr. Franklin John disclosed that he has secured a MBA and Ph.D, both from the State run Universities. But since the minutes of the Selection Committee were not produced, the University could not consider his appointment. Therefore, we issued a positive direction on 08-09-2016 to take into account the appointment of Dr. Franklin John. This order has been complied with and affiliation granted. Therefore, no further orders are necessary in this writ petition. Hence, it is closed.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
