THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.42863 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. With their consent, the present writ petition is disposed of at the admission stage.

2.

The present writ petition came to be filed with the following prayer:

"....to issue a writ or direction preferably a writ in the nature of writ of mandamus or any other appropriate writ declaring action of the respondent No.2 in not passing any orders on the petitioner application dt.03.06.2016 for conversion of his land in Sy.Nos.548, 549, 550, 551, 552, 555, 556, 557 and 558 of Kondamadugu Village, Bibinagar Mandal, Nalgonda District, as illegal, arbitrary, contrary to the Section 4 of the A.P. Agricultural Land (Conversion for Non Agricultural purposes) Act, 2006 and unconstitutional and consequently direct the respondent No.2 to pass orders for conversion of land of the petitioner from agricultural to non-agricultural." 3.

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent authorities to consider the representation dated 03.06.2016 made by the petitioner for conversion of his agricultural land mentioned above to nonagriculture purpose.

4.

Learned Government Pleader for Revenue would submit that he has no objection for the same provided the said representation is still pending consideration.

5.

Having regard to the submissions made, the Writ Petition is disposed of directing the 2nd respondent to consider the representation dated 03.06.2016 made by the petitioner for conversion of his agricultural land in Sy.Nos.548, 549, 550, 551, 552, 555, 556, 557 and 558 of Kondamadugu Village, Bibinagar Mandal, Nalgonda District, to non-agriculture purpose in terms of Section 4 of the A.P. Agricultural Land (Conversion for Non Agricultural purposes) Act, 2006 in accordance with law, as early as possible preferably within a period of six (06) weeks from the date of receipt of a copy of this order, after hearing the petitioner and the aggrieved persons, if any.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C. PRAVEEN KUMAR Date:09.12.2016 INL
