THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39517 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in issuing notice No.GPN/145/2017. dated 09.11.2017, to demolish the house building of the petitioner at Plot No.17, Sy.No.148, admeasuring 250 Sq.yards, situated at Nagaram Village and Gramapanchayat, Keesara Mandal, Medchal, Malkajgiri District, as illegal and arbitrary and for a consequential direction to the 2nd respondent not to demolish the aforesaid house building.

Heard learned counsel for the petitioner and Sri G.Narender, learned Standing Counsel for respondent No.2. Admittedly, petitioner was granted building permission on 08.08.2017 vide permission No.GPN/N-50/2017-18. A reading of the impugned proceedings dated 09.11.2017 goes to show that petitioner's building permission was cancelled without issuing any notice to the petitioner.

In view of the same, on the ground of violation of principles of natural justice, the impugned order is set aside. However, this order will not preclude the competent authority from taking action after following due process of law.

Accordingly the writ petition is allowed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
