This Writ Petition is filed under Article 226 of the Constitution of India challenging the impugned notice dated:14.11.2017 issued by the 4th respondent, calling upon the petitioner to remove the unauthorised construction More super market and Med Plus shop as highly illegal, arbitrary, unconstitutional and violative of Articles 14, 21 and 300-A of the Constitution of India apart from violation of principles of natural justice.

At the time of arguing the matter, both the Counsel submitted that the 4th respondent issued show cause notice to the petitioner on 14-11-2017 directing the petitioner to submit his explanation. Both the Counsel further submitted that the petitioner has submitted his explanation on 16-11-2017 to the show cause notice dated:14.11.2017.

Having regard to the fact that since the petitioner has submitted his explanation on 16-11-2017, to the show cause notice dated:14.11.2017, the 4th respondent is directed to consider the explanation of the petitioner dated:16-11-2017 and pass orders in accordance with law.

The Writ Petition is disposed of with the above direction. No order as to costs.
