THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.39509 of 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India to declare the action of the respondents in seizing the Tractor and Trailer bearing No.TS05EK 5739 and TS05EK 5740 without following any procedure under statute contemplated under Section 9Q sub section 7 of Minor Mineral Concession Rules, belonging to the petitioner as being illegal, arbitrary and against the principles of natural justice and violative of Articles 14, 16 19 (1) (g), 21, 300-A and 301 of the Constitution of India and consequently direct the respondents to release the petitioner's Tractor and Trailer bearing No.TS05EK 5739 and TS05EK 5740 forthwith, and to pass appropriate orders.

At the time of arguments, the only relief sought by the learned Counsel for petitioner is to direct the 2nd respondent to dispose of the application, if any, filed by the petitioner. 3.

In view of the submissions made, the 2nd respondent is directed to dispose of the application, if any, filed by the petitioner, in terms of G.O.Ms.No.15, Industries and Commerce (Mines-I) Department, dated:19-02-2015, within three days from the date of filing of the Application.

With the above direction, the Writ Petition is disposed of. No order as to costs.
