The writ petition was listed on 26.10.2016 and at request of learned Government Pleader (Civil Supplies), the writ petition is adjourned to today for getting instructions on whether the second respondent afforded opportunity of hearing to petitioner before communicating the impugned memo No.G6/ 245/ 2016 dated 17.10.2016. The issue arises under the Andhra Pradesh Petroleum Products (Licensing and Regulation of Supplies) Order, 1980. 2.
Learned Government Pleader, on written instructions, admits that the second respondent did not put the petitioner on notice or give copies of report on which the conclusions in the impugned memo are arrived at. Therefore, he submits for setting aside the memo impugned in the writ petition and remitting the matter to second respondent. 3.
The statement of the learned Government Pleader is placed on record and accepted. The memo impugned in the writ petition is set aside and the matter remitted to second respondent for consideration and disposal of the case within four (4) weeks from today. It is needless to observe that the second respondent not only affords opportunity to petitioner but also gives copies of report/ documents on which the enquiry pending before him is proceeded with.
The writ petition is ordered as indicated above. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
