THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO WRI T PETI TI ON No.39476 OF 2017 ORDER:

The petitioner claims to be a purchaser of 0.48 cents of land in Sy.No.196/1 and 0.25 cents in Survey No.50/1 at Damineedu Revenue Village. At the time of purchase, when 'No Objection Certificate' was insisted, the petitioner filed WP.No.13231 of 2014 and this Court directed the Sub-Registrar, Renigunta, Chittoor district, to receive the document and consider the same for registration without insisting for 'No Objection Certificate' by order dated 25.4.2014. Pursuant thereto, the sale deed was received and it was given pending Registration No.168 of 2014 on 19.12.2014. 2.

It appears that the property purchased by the petitioner is included in the list of prohibited properties and that the vendors of the petitioners filed Writ Petition No.8362 of 2015 challenging the inclusion, this Court disposed of the said Writ Petition on 21.7.2016 giving them liberty to approach the Committee constituted for the purpose of considering the grievances relating to the wrongful inclusion of the properties as per the Full Bench Decision in the case of VI NJAMURI RAJAGOPALA CHARY vs. STATE OF ANDHRA PRADESH AND OTHERS1. The vendors did not approach the Committee but the petitioner appears to have submitted an application on 12.9.2017 and when the said application is not 1 2016 (2) ALD 236 (FB)

disposed of, the present Writ Petition is filed for releasing the pending document No.168 of 2014.

The said document cannot be directed to be released without considering the representation of the petitioner dated 12.9.2017 by the Committee constituted under GO.Ms.No.300 dated 5.7.2016. 4.

In view of the same, this Writ Petition is disposed of directing the 2nd respondent to consider the representation of the petitioner dated 12.9.2017 and pass appropriate orders thereon, within a period of three months from the date of receipt of a copy of this order and depending on the result of the decision of the Committee, the 6th respondent shall act in accordance with law. 5.

Writ Petition is accordingly, disposed of.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
