ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus declaring the action of the 1st respondent in issuing the proceedings dated 06.11.2001 as arbitrary, illegal and consequently to direct the respondents to consider the case of the petitioner for promotion to the post of Deputy Executive Engineer. Heard Sri Ch.Satish Kumar, learned counsel appearing for the petitioner and Sri G.Seena Kumar, learned counsel appearing for the respondents.

It is the case of the petitioner that initially, he was appointed as Supervisor in the year 10-05-1986. Later, he was promoted as Assistant Engineer on 20-02-1988. Since the petitioner was a Graduate, his case was considered for promotion as Assistant Executive Engineer on 01.01.996. When his case was not considered for promotion to the post of Deputy Executive Engineer, the present writ petition is filed. Learned counsel appearing for the respondents submits that the petitioner was promoted as Deputy Executive Engineer during pendency of the writ petition, which was not disputed by the learned counsel appearing for the petitioner. Therefore, the cause in the Writ Petition does not survive for adjudication and accordingly, the Writ Petition is closed. No costs.
