THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34434 OF 2017 ORDER:

The petitioners state that they are farmers and permanent residents of Undavalli Village coming under CRDA Unit-8 of Tadepalli Mandal, Guntur District. An extent of Acs.4.10 cents situated in Survey No.11 along with other lands are sought to be acquired for the development of the Capital and for providing access roads. A Notification was issued on 03.09.2017 and the petitioners were issued notices to submit their objections on or before 04.11.2017 and further stating that the objections would be considered on 18.11.2017 before the eighth respondent.

Though the petitioners submitted representation on 11.09.2017, since the said representation is prior to the notices issued on 12.09.2017, this writ petition is disposed of giving liberty to the petitioners to file comprehensive objections pursuant to the notices issued on 12.09.2017, on or before 04.11.2017 and the eighth respondent is directed to consider the said objections before proceeding further according to the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Till a reasoned order is passed by the respondents, the petitioners shall not be dispossessed from their lands. The writ petition is accordingly disposed of.

Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
