THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.43678 of 2018 ORDER:
Heard learned counsel for the petitioners and the learned Government Pleader for Home, apart from perusing the entire material available on record.
There are two contradicting letters, placed before this Court, one is in favour of the petitioners by the learned counsel for the petitioners and the other on behalf of the respondent authorities.
In the letter, dated 05.12.2018, placed on record by the learned counsel for the petitioner, it is stated that permission to conduct Dr.K.A.Paul's Political, Peace and Christmas celebrations on 08.12.2018, without disturbing the school, is granted. In the other letter, dated 05.12.2018, addressed to the Sub-Divisional Police Officer, Narsapuram Division, Narsapuram, it is stated by the Self-same Correspondent of the school that they cannot accord permission to conduct the said meetings.
In view of the above, this Court cannot now go into the said aspect, whether which letter is correct. Since the permission already granted in favour of the petitioners by the respondents is in force as on today, the representative of the petitioners or the petitioners themselves can approach the police, along with the Correspondent of the school, for clarification on the said contradiction and, thereafter, it is open
for the police authorities to take action, strictly in accordance with law.
With the above observation, Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
