ORDER

This writ petition is filed seeking to issue a Writ of Certiorari calling for the records relating to and connected with the Award dated 07.01.2002 passed in I.D.No.262 of 1999 by the Industrial Tribunal-cum-Labour Court, Ananthapur and quash or set aside the same.

Heard Sri Aravala Rama Rao, learned Standing Counsel appearing for the petitioner-Corporation, Sri Kamalakara Rao Bathina, learned counsel appearing for the 1st respondentworkman and learned Government Pleader appearing for the 2nd respondent.

When the matter is taken up for hearing, it is noticed that the respondent-workman had challenged the very same impugned Award passed in I.D.No.262 of 1999, dated 07.01.2002 by filing W.P.No.22836 of 2002 before this Court. This Court vide order 16.12.2013 disposed of the said writ petition with the following direction.

"Accordingly, this Writ Petition is disposed of setting aside the punishment imposed by the 1st respondentTribunal. The petitioner is ordered to be reinstated into service together with continuity of service and attendant benefits. He is awarded the punishment of withholding of 2 (two) annual increments with cumulative effect. He shall not be entitled to back wages during the period he was out of service."

Since the Award passed by the Industrial Tribunal in I.D.No.262 of 1999, dated 07.01.2002, was modified by this Court in W.P.No.22836 of 2002, dated 16.12.2013, at the instance of the respondent-workman, this Writ Petition is also liable to be disposed of in terms of the said order.

Accordingly, the Writ Petition is disposed of in terms of the order dated 16.12.2013 passed in W.P.No.22836 of 2002. No costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________________ JUSTICE ABHINAND KUMAR SHAVILI 16th August, 2018 rkk
