HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.38478 OF 2017 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation appearing for respondents 1 to 5.

It is not in dispute that the Executive Engineer is the concerned authority for determining the contract in terms of Clause 60 (a) of A.P. Standard Specifications, but the impugned order is passed by the 3rd respondent-Superintendent Engineer. The said aspect is not disputed by the learned Assistant Government Pleader for Irrigation.

In view of the same, the impugned order is set aside and the concerned Executive Engineer is directed to pass appropriate orders, within a period of two weeks from the date of receipt of a copy of this order. Till then, no further steps for issuance of tender notification in respect of the same work shall be undertaken.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this Writ Petition, miscellaneous petitions, if any, pending shall stand closed.
