HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43682 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents in not passing any orders on the applications dated 2.7.2013 and 11.9.2018 submitted by the petitioner seeking renewal of license for quarry lease in the land admeasuring 13.796 hectares situated in Sy.No.2 of Chikkavaram Village, Gannavaram Mandal, Krishna District, as illegal and arbitrary.
Though various grounds are raised, Smt N. Sobha, learned counsel for the petitioner would submit that there is no point in keeping the applications submitted by the petitioner seeking to renew the quarry lease for the subject property, pending for such a long time. She further submits that it would be just and proper, if the orders are passed on the applications submitted by the petitioner either in accepting or rejecting the same, at the earliest. Learned Government Pleader for Mines and Geology, would submit that steps would be taken to pass appropriate orders on the latest applications submitted by the petitioner seeking renewal of the quarry lease for the subject property, in accordance with law, at the earliest.
Having regarding to the above, the writ petition is disposed of directing the 3rd respondent-Deputy Director of Mines and Geology, to deal with the applications dated 2.7.2013 and 11.9.2018, submitted by the petitioner seeking to renew the quarry lease for the subject
property, after paying the deficit fees, in accordance with law, as early as possible, preferably within a period of three to four months from the date of receipt of copy of this order, after giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.
