THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37319 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of 3rd respondent in not conducting the investigation and not taking any action against the 4th respondent basing on FIR No.319 of 2016, as illegal and arbitrary. Heard and perused the material available on record. The petitioner has lodged the present complaint before the 3rd respondent against the 4th respondent for not registering Plot No.18, situated in Survey Nos.44 & 45, at Vaviletippadu Village, Nellore, in favour of the son-in-law of the petitioner till date. The 3rd respondent registered the complaint as FIR No.319 of 2016, but from the date of registration of crime, the 3rd respondent is not investigating the matter and not taking any action against the 4th respondent. Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.319 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
