THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5787 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to dispense with the presence in C.C.No.27 of 2013 on the file of the Principal Special Judge for CBI Cases at Hyderabad on all dates of hearing, arising out of offences under Sections 120-B read with sections 420, 409, 420, 468, 471 and 477A IPC and Sections 9, 11, 12, 13(2) read with 13(1)(c) and (d) of the Prevention of Corruption Act, 1988.

Heard and perused the material available on record. Learned counsel for the petitioners confines his argument with regard to dispensing with the presence of the petitioners before the Court below.

Considering the facts and circumstances of the case and also considering the fact that the entire case is based on the documents, the presence of the petitioners herein is dispensed with except on the dates when the trial Court insists for their appearance. The petitioners shall be represented through their counsel before the Court below on all hearing dates, except on the dates when the Court below insists for their appearance.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 21.04.2016 pln
