HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.4421 of 2002 ORDER:

This Writ Petition is filed seeking a Writ of Certiorari to call for the records in I.D.No.104 of 2000 dated 27.08.2001 on the file of Labour Court, Godavari Khani, Karimnagar District, and to quash the same as illegal and arbitrary. Heard Sri A.Ravi Babu, learned Standing Counsel for the petitioner - Corporation and Sri Deepak Deshpande, learned counsel for respondent No.1 - workman.

It is contended by the learned Standing Counsel appearing for the petitioner - Corporation that respondent No.1 - workman was appointed on contract basis and raised an industrial dispute seeking regularization of her services on completion of 240 days and that the Industrial Tribunal-cumLabour Court, Godavarikhani, by its award dated 27.08.2001 in I.D.No.104 of 2000, directed to regularize the services of respondent No.1 as Technical Assistant from the date of the award. He further contended that though workman was entitled for consideration on completion of 240 days of service subject to availability of vacancy and other factors but, however, the Labour Court mechanically directed that respondent No.1 - workman should be regularized on completion of 240 days of service. Learned Standing Counsel has brought to the notice of

this Court that respondent No.1 was appointed as a Conductor vide proceedings dated 17.04.2000 and, presently, working as such.

Counsel for respondent No.1 contended that many, of the workmen in the Andhra Pradesh, were regularized on completion of 240 days of service and, therefore, respondent No.1 is entitled for regularization of her services from the date of her initial appointment.

Having considered rival submissions, and as the Labour Court directed the petitioner - Corporation herein to regularize respondent No.1 on completion of 240 days of service subject to availability of vacancy, and since respondent No.1 has already been appointed as a Conductor on regular basis on 17.04.2000, and since the petitioner - Corporation has regularized the services of respondent No.1 on its own, no further orders are necessary in the writ petition and, accordingly, the Writ Petition is closed.

Miscellaneous petitions, if any, pending, shall stand closed. No costs.
